1. ABOUT PAKHRIN ILLUSTRATIONS

Pakhrin Illustrations is a freelance creative practice operated by Ankita Tamang, based in Canada. Services include original watercolour paintings, bespoke glass and wood engraving, fashion design, and fashion styling for clients across Canada and India. These Terms govern all engagements with Pakhrin Illustrations and all use of the website at https://pakhrin.design.

2. USE OF THIS WEBSITE

You may use this website for personal, non-commercial purposes only. You agree not to:

• Copy, reproduce, or redistribute any content without written permission
• Use any images or artwork for commercial purposes without a licence
• Attempt to interfere with or damage any part of the website
• Submit false or harmful information through the contact form
• Use automated tools to scrape content from the site

3. COMMISSION ENQUIRIES AND BOOKING

Enquiries — submitting the contact form is an expression of interest only and does not constitute a binding agreement.

Quotation — a personalised quote and timeline will be provided within 48 hours. Quotes are valid for 14 days.

Confirmation — a commission is confirmed only when both parties have agreed on scope, timeline, and price in writing (by email), and the required deposit has been received. Work does not begin before both conditions are met.

Availability — acceptance of a commission is subject to availability. We reserve the right to decline any commission at our discretion.

4. PRICING, DEPOSITS AND PAYMENT

All prices are quoted in Canadian dollars (CAD) unless otherwise stated.

• Deposit — a non-refundable deposit (typically 50% of the total) is required to confirm a booking.
• Balance — the remaining balance is due before the completed work is shipped or transferred.
• Payment methods — accepted methods will be confirmed at the time of booking (e-transfer, PayPal, or other agreed method).
• Price changes — quoted prices are fixed once the commission is confirmed in writing.

5. CANCELLATIONS AND REFUNDS

Client cancellations

• Deposits are non-refundable once work has commenced.
• If you cancel after work has begun, you will be charged for work completed to that date at a pro-rata rate.
• Completed physical works are non-refundable once shipped.

Artist cancellations — in the unlikely event of cancellation on our side, a full refund of any deposit paid will be issued within 14 days.

Disputes — if you are dissatisfied with a completed work, please contact us within 7 days of receipt. We will work in good faith toward a fair resolution.

6. INTELLECTUAL PROPERTY AND COPYRIGHT

Ownership of the physical work — you receive ownership of the physical artwork or object upon final payment. Title passes at the point of delivery.

Copyright — unless explicitly agreed otherwise in writing before the commission begins, Pakhrin Illustrations retains copyright in all artwork and creative works produced, including:

• The right to photograph, reproduce, and share images of completed pieces for portfolio and promotional purposes
• The right to enter works into exhibitions or competitions
• All reproduction and moral rights under the Copyright Act (Canada)

Copyright transfer — if you require full copyright transfer or exclusive commercial rights, this must be agreed in writing before the commission begins and will involve an additional licensing fee.

Website content — all content on pakhrin.design is the intellectual property of Pakhrin Illustrations and may not be reproduced without written permission.

7. DELIVERY AND SHIPPING

• Physical commissions are shipped with tracked services across Canada. Shipping to India is available on request; additional charges apply.
• Estimated delivery timelines are in addition to the production timeline and are provided at the time of commissioning.
• All pieces are packaged with professional protective materials. Pakhrin Illustrations is not liable for damage, loss, or delay caused by the carrier once dispatched with tracking.
• If a piece is damaged in transit, photograph the packaging and artwork immediately and contact us within 48 hours.
• Customs duties or import taxes for international shipments are the responsibility of the recipient.

8. REVISIONS AND APPROVAL PROCESS

The number of included revision rounds is agreed at the time of commissioning.

• For artwork: a progress photo is shared at an agreed milestone for review. Significant changes after this point may incur additional fees.
• For engraving: a design sketch is provided for approval before any engraving begins.
• For fashion design: sketches and material swatches are shared for approval before production begins.
• Once you have approved a final proof, we cannot accept liability for errors you have approved.
• Additional revisions beyond those included will be quoted separately.

9. YOUR RESPONSIBILITIES

To enable us to complete your commission, you agree to:

• Provide accurate and complete information (reference photos, measurements, etc.) in a timely manner
• Respond to review requests within agreed timeframes — delays on your side may affect the delivery timeline
• Ensure reference materials you provide do not infringe third-party intellectual property rights
• Pay in accordance with the agreed payment schedule

10. LIMITATION OF LIABILITY

To the maximum extent permitted by Canadian law, Pakhrin Illustrations is not liable for:

• Indirect, incidental, or consequential damages arising from a commission engagement
• Damage, delay, or loss caused by third-party carriers during shipping
• Dissatisfaction with a creative outcome where the work was completed in accordance with the agreed brief

Our total liability in relation to any commission shall not exceed the total amount you paid for that commission.

11. THIRD-PARTY LINKS AND SERVICES

This website contains links to third-party platforms including Instagram, Facebook, Behance, and LinkedIn. We are not responsible for those sites. Contact form submissions are handled by Formspree; use of that service is subject to their own terms.

12. GOVERNING LAW

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada. Any disputes shall be subject to the exclusive jurisdiction of the courts of Ontario.

13. CHANGES TO THESE TERMS

We may update these Terms at any time. Changes will be posted on this page with an updated date. For active commissions, the terms in place at the time of your commission confirmation apply.
